EMS Barcode Solutions – Terms of Service

These Terms of Service (“Terms”) govern the sale of hardware, software, and related services (“Products” or “Services”) provided by EMS Barcode Solutions, LLC (“EMS Barcode,” “we,” “us,” or “our”) to you (“Customer,” “you,” or “your”). By purchasing from us, you agree to these Terms.

1. Orders & Payment

• All orders are subject to acceptance by EMS Barcode.

• Payment terms will be stated on your invoice. Unless otherwise agreed in writing, payment is due in full before shipment.

• Late payments may be subject to interest charges at the maximum rate allowed by law.

2. Shipping & Delivery

• Delivery dates are estimates only. We are not liable for delays caused by carriers, customs, or other factors outside our control.

• Risk of loss passes to the Customer upon delivery to the carrier.

3. Products & Services​

• Product specifications and compatibility are the responsibility of the Customer to verify before purchase.

• Professional services, support, or installation (if applicable) may be governed by a separate agreement.

4. Warranty

• EMS Barcode provides a standard warranty for certified hardware, as disclosed in product documentation or invoices.

• Warranty does not cover misuse, unauthorized modifications, accidents, or damage caused by third-party software or improper network configurations.

• Extended warranties may be available for purchase.

5. Refund & Cancellation Policy

Cancellations

• Orders may be cancelled within 24 hours of placement if the order has not yet shipped.

• After shipment, cancellations are not possible, and the Return Policy applies.

Returns & Refunds

• Eligible products may be returned within 30 days of delivery for a refund, subject to inspection.

• To qualify, returned items must:

  • Be unused and in original condition.

  • Include all accessories, manuals, and packaging.

  • Have a valid Return Merchandise Authorization (RMA) number issued by EMS Barcode.

• A restocking fee of up to 20% may apply.

• Refunds will be issued to the original payment method within 10 business days of receipt and inspection.

• Shipping costs are non-refundable. Customer is responsible for return shipping unless the return is due to EMS Barcode’s error.

Non-Returnable Items

• Custom-configured hardware, software licenses, labels, and consumables are non-returnable.

• Any product damaged due to improper use or installation will not be eligible for refund.

6. Limitation of Liability

• EMS Barcode is not liable for indirect, incidental, or consequential damages, including loss of data, profits, or business opportunities.

• Our liability for any claim is limited to the amount paid for the specific product or service at issue.

7. Compliance & Use

• Customer is responsible for using products in compliance with all applicable laws and regulations.

• EMS Barcode does not permit its hardware to be used for unlawful activities.

8. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

9. Changes to Terms

We may update these Terms at any time. Updates will be posted on our website and apply to future transactions.
